THIS LEAVE AND LICENSE AGREEMENT (“Agreement”) is made and executed at Karnataka on this __, BY AND BETWEEN:

(HEREINAFTER called the “Licensor” which expression shall mean and include the Licensor above named as also his/her respective heirs, successors, assigns, executors and administrators)
AND
__, PAN: __ residing at __, email id __
(HEREINAFTER called the “Licensee” which expression shall mean and include the Licensee above named as also his/her respective heirs, successors, assigns, executors and administrators)
Each as “Party” and collectively as the “Parties”.
WHEREAS the Licensor is absolutely seized and possessed of and or otherwise well and sufficiently entitled to all that constructed portion being unit described in Schedule A Property hereunder written and are hereafter for the sake of brevity called or referred to as Licensed Premises.
AND WHEREAS the Licensee herein needs temporary premises for his/her own use and has approached the Licensor with a request to allow the Licensee herein to use and occupy the said Licensed Premises on Leave and License basis for a period of 11 Months commencing from __ and ending on __, on terms and subject to conditions hereafter appearing.
AND WHEREAS the Licensor has agreed to allow the Licensee herein to use and occupy the said Licensed Premises for his/her aforesaid purposes only, on Leave and License basis for the above mentioned period, on terms and subject to conditions hereafter appearing.
NOW THEREFORE IT IS HEREBY AGREED TO, DECLARED AND RECORDED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS:
Period
That the Licensor hereby grants to the Licensee herein a revocable leave and license, to occupy the Licensed Premises, described in Schedule A Property hereunder written without creating any tenancy rights or any other rights, title and interest in favour of the Licensee for a period of 11 Months commencing from __ and ending on __ (“License Term”). After the Agreement Period is over, if the Licensee wants to stay for the next 11 months, then the Licensee shall pay enhanced rent at 5% (either or as per the market rate) on the existing rent for the next period of 11 months on the same terms and conditions of this agreement.
1. LICENSE FEES
The Licensee hereby agrees and undertakes to pay to the Licensor, on or before the 5th day of every month, (subject to statutory deduction of tax at source and / or any other statutory deductions as are applicable from time to time), a license fee of __ (__) per month for the Licensed Premises, which is exclusive of maintenance charges. The monthly license fee shall be payable on or before the 5th of each successive month to the Licensor’s bank account. Failing which a penalty of Rs. 200/- per day only will be payable by the Licensee from the due date onwards.
2. Security Deposit
The Licensee shall pay to the Licensor, as refundable interest free security deposit for due observance and performance of the terms and conditions of this Agreement, a sum of __ (__). The said Security Deposit shall be payable on execution of this Agreement. The Security Deposit shall be refunded by the Licensor to the Licensee after deducting any dues towards unpaid electricity, telephone, broadband connectivity bills etc. at the time of vacating the Licensed Premises on the expiry of this Agreement by efflux of time or on its sooner determination / termination as provided herein.
3. Maintenance Charges
The license fee is exclusive of maintenance charges. In addition to the license fee, the Licensee shall bear and pay all the maintenance charges in respect of the Licensed Premises. All other outgoings, including all rates, taxes, levies, assessments, non-occupancy charges, etc. in respect of the Licensed Premises shall be paid by the Licensor.
4. UTILITIES
It is agreed by the Parties that the Licensee shall be responsible for payment of water bills and electricity bills as per consumption for the Licensed Premises during the License Term directly to the concerned authorities, extra besides the aforesaid monthly License Fees. It is further agreed that the Licensee shall hand over the paid receipts of the same to the Licensor from time to time.
5. TERMINATION
The Licensor and the Licensee shall have the option of terminating this Agreement by giving 30 days written notice to the other Party. Further, it is agreed by the Parties that the Licensor may terminate this Agreement on an immediate basis in the event the License Fees is not paid for more than 30 days from the due date of the payment.
6. Alteration
It is agreed by the Parties that the Licensee shall not make or permit to do any alteration or addition to the construction or arrangements (internal or external) to the Licensed Premises without previous consent in writing from the Licensor.
7. No Tenancy
It is agreed by the Parties that the Licensee shall not claim any tenancy right and shall not have any right to transfer, assign, sublet or grant any license or sub-license in respect of the Licensed Premises or any part thereof and also shall not mortgage or raise any loan against the said premises.
8. Inspection
It is agreed by the Parties that the Licensor shall, on reasonable notice given by the Licensor to the Licensee, have a right of access either by himself/herself or through an authorized representative to enter, view and inspect the Licensed Premises at reasonable intervals.
9. Use
It is agreed by the Parties that the Licensed Premises shall only be used by the Licensee for residential purpose. The Licensee shall maintain the said premises in its existing condition and damage, if any, caused to the said premises, the same shall be repaired by the Licensee at its own cost subject to normal wear and tear. The Licensee shall not do anything in the said premises which is or is likely to cause a nuisance to the other occupants of the said building or to the prejudice in any manner to the rights of Licensor in respect of said Licensed Premises or shall not do any unlawful activities prohibited by State or Central Government. The Licensee shall undertake to indemnify the Licensor from any claim, demands, penalties and losses of any nature by virtue of commercial identity.
10. Possession
It is agreed by the Parties that immediately on the expiration or termination or cancellation of this Agreement, the Licensee shall vacate the said premises without delay with all his/her goods and belongings. The Licensee will be charged 30 days of rent towards re-painting & restoration charges. Such amount, if not paid, shall be a valid deductible from the Security Deposit. In the event of the Licensee failing and / or neglecting to remove himself/herself and / or his/her articles from the said premises on expiry or sooner determination of this Agreement, the Licensor shall be entitled to recover damages at the rate of double the daily amount of compensation per day and or alternatively the Licensor shall be entitled to remove the Licensee and his/her belongings from the Licensed Premises, without recourse to the Court of Law.
11. Association Rules and Regulations
The Licensee shall always be bound by the Rules and Regulations of the Community as promulgated by the __ (“Association”). Association dues in any form attributable to the Licensee’s act, conduct, usage or consumption shall be payable by the Licensee. Licensee is liable to pay Move-In and Move-Out charges as prescribed by the Association.
12. Pets
The Licensee shall seek permission from the Licensor before letting in any species of animals or birds that are generally classified as pets. Permission, if granted, shall be subject to Licensee’s abidance to Association’s Rules & Regulations related to Pets.
13. Registration
This Agreement shall be stamped and, where required, registered as per applicable law. The expenditure of stamp duty, registration fees and incidental charges, if any, shall be borne by the Licensee.
14. NOTICE
Any notice in terms of this Agreement, by either side will be served at the address stated above by registered AD post/Speed Post unless a different address has been intimated in writing against receipt, or by the email id stated above. Upon the receipt of any notice, order, direction from the competent authority (including notices affecting the rates, taxes or other outgoing in respect of the Premises payable in whole or in part by the Licensor) the Licensee shall immediately deliver a copy of it to the Licensor. Cost of repair/restoration of any damage to the Premises during the pendency of Leave and License agreement should be cleared by Licensee.
15. Statutory Compliance
It is agreed by the Parties that each Party shall abide by the rules and regulations of Karnataka statutory authorities.
16. JURISDICTION
Any dispute relating to this License Agreement shall be subject to jurisdiction of Courts at Bengaluru.
