What a rental agreement does
A rental agreement, often called a leave and license agreement, is the written record of what the owner and the tenant agreed: the rent, the deposit, how long the stay lasts and what happens if either side wants to leave. When there is a disagreement months later, this paper is what people point to. Most disputes over deposits and notice periods come from agreements that were vague or never written down.
What a good agreement should cover
- Names and addresses of the owner and the tenant, and the full address of the flat.
- Monthly rent and the date it is due each month.
- Security deposit, and exactly when and how it is returned.
- Start date, the length of the stay and any lock-in period.
- Notice period if either side wants to end the stay early.
- Yearly rent increase, if any.
- Who pays maintenance, electricity, water and other bills.
- Rules on repairs, subletting and how the flat may be used.
- The condition of the flat and its fittings when the tenant moves in.
Writing these down on day one is the cheapest protection either side can have. Our guide to security deposit refund rules shows how a clear clause saves an argument at move-out.

Mistakes that cause trouble later
- Verbal promises that are not in the agreement, such as a free repair or an early exit.
- No clear date for returning the deposit after the tenant leaves.
- No notice period, so one side leaves or asks the other to leave with no warning.
- No record of the flat’s condition at move-in.
- Skipping tenant checks. An agreement protects you after a problem starts. A check helps you avoid it.
Before you sign, consider a court record check on the tenant. If a tenant stays on after the lease ends, read what to do when a tenant does not vacate.
